These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” “user,” or “participant”) and Ashu Yoga, owned and operated by Ashutosh Kshatriya and Karena B. (“Ashu Yoga,” “we,” “us,” or “our”). By accessing, browsing, using, or participating in any part of the Ashu Yoga ecosystem—including but not limited to our website(s), subdomains, squeeze/opt‑in pages (e.g., ClickFunnels pages), downloadable materials, free video sessions, email communications, WhatsApp conversations, social media channels, live or recorded virtual sessions, 1‑on‑1 guidance, memberships, workshops, events, or any other services we provide (collectively, the “Service”)—you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease use of the Service.
1. Acceptance of Terms
By continuing to access or use the Service, you affirm that you can form a legally binding contract under applicable law, and you agree to comply with these Terms and all applicable local, state, national, and international laws and regulations. If you are accepting these Terms on behalf of an organization or entity, you represent and warrant that you have the authority to bind such entity to these Terms.

For clarity within these Terms:
“Service” includes all digital and physical offerings of Ashu Yoga: websites, emails, content, videos, assessments, live or recorded sessions, 1‑on‑1 guidance, workshops, retreats, and any future products or materials.
“Content” means any text, audio, video, images, graphics, documents, or other materials, whether created by Ashu Yoga or submitted by users.
“Lead Magnet” refers to free resources (e.g., the 35‑minute healing video) provided in exchange for contact information (e.g., name, email, phone).
“User Content” refers to any text, audio, video, image, testimonial, feedback, or message you submit to us through forms, WhatsApp, social media, email, or during sessions.
“Third‑Party Service(s)” refers to platforms not owned or operated by Ashu Yoga (e.g., ClickFunnels, Zoom, WhatsApp, payment gateways).
3. Eligibility & Age Requirement
The Service is intended for individuals who are 18 years or older. By using the Service, you confirm that you are at least 18. We do not knowingly collect personal data from anyone under 18. If we discover such data has been provided, we will promptly delete it. Parents or guardians who believe their child has provided us information should contact us immediately.
4. Nature of the Service (Educational & Spiritual Guidance Only)
Ashu Yoga offers guidance rooted in Vedic yoga philosophy, the Pancha Kosha framework, Ayurveda principles, and trauma-informed, nervous system–sensitive practices. Testimonials, case studies, and client stories describe unique personal experiences and do not guarantee that you will achieve the same results. Your outcome depends on many factors—commitment, health history, life context—and cannot be predicted.
Our Content, sessions, and tools are designed for educational and personal development purposes and do not constitute medical, psychiatric, or psychological advice, diagnosis, or treatment. We are not a licensed healthcare provider, nor do we present ourselves as such. Always consult with your physician or qualified health professional regarding any medical condition, health concerns, or fitness decisions. You acknowledge that you are responsible for your own well-being and choices.
5. Health, Safety & Physical Risk Disclaimer
Participation in any movement, breathwork, or meditative practice involves inherent risks. You agree to listen to your body and stop immediately if you experience pain, dizziness, shortness of breath, numbness, panic, or any distress. You must not disregard or delay seeking medical advice because of something you have read or experienced through the Service. If you have any injury, chronic illness, surgery history, pregnancy, cardiovascular condition, or mental health concern, consult your healthcare provider prior to engaging with our practices. You acknowledge and voluntarily assume all risks associated with your participation and release Ashu Yoga from any responsibility for injuries or health outcomes.
6. Emergency Situations
Ashu Yoga is not a crisis or emergency support service. If you are in immediate danger, experiencing acute mental health symptoms, or considering self-harm, contact your local emergency number or a qualified mental health professional immediately. Do not rely on the Service for urgent assistance.
7. User Responsibilities & Conduct
You agree to:
Provide accurate, current information when interacting with our forms or communications.
Use the Service only for lawful, personal, and non-commercial purposes.
Refrain from harassing, abusing, threatening, or otherwise harming our team or other users.
Avoid uploading or transmitting malicious code (viruses, worms, Trojans).

Respect the confidential, sacred nature of healing environments and not share confidential group details publicly.
In addition to prior rules, you agree not to:
disseminate hateful, extremist, or discriminatory content;

We reserve the right to restrict or terminate your access if we believe your conduct violates these Terms or the spirit of our work.
8. Registration, Accuracy & Security
Certain parts of the Service may require you to submit personal data (e.g., to receive the free video). You agree to provide only accurate and complete information, and to update us if your information changes. You are responsible for securely managing your communication devices and e-mail account to ensure only you can access communications from us. If you suspect unauthorized use of your information or our communications, notify us at once.
9. Communications Consent (Email, WhatsApp & SMS)
By providing your contact details, you consent to receiving e-mails, WhatsApp messages, or phone calls related to your healing journey, resources, event updates, or invitations to deeper work (with no obligation to accept). You can withdraw consent at any time by using the unsubscribe link in emails, blocking or messaging “STOP” on WhatsApp, or contacting us directly. We do not spam; every message is sent thoughtfully.
10. Free Resources & Lead Magnets
To access our free 35‑minute healing video or similar resources, we ask for your name, email, and possibly your phone number. This exchange lets us deliver the resource and continue supporting you with relevant material. You agree that by submitting your information, you are opting in to receive communications as part of your journey. You may opt out at any time, and you will still retain access to previously delivered materials (unless otherwise stated).
11. Fees, Payments, Refunds & Cancellations (Where Applicable)
Some parts of the Service may be offered for a fee—such as personalized protocols, workshops, memberships, or future programs. Unless otherwise stated in writing:
Fees are quoted in INR or USD (as applicable) and must be paid in full at the time of booking or as scheduled.
You are responsible for any currency conversion, transfer, or bank fees.
Refund policies will be clearly outlined at the point of purchase; in general, due to the nature of personalized guidance and digital delivery, fees are non-refundable once a session has been delivered or a program has started.
Chargebacks or payment disputes must first be addressed with us. Illegitimate chargebacks may result in account termination and legal action.
12. Scheduling & Cancellation Policies for 1‑on‑1 Sessions
If you arrange a private session via WhatsApp or email:
You agree to provide at least 24 hours’ notice for any cancellation or rescheduling.
Late cancellations or no-shows may lead to forfeiture of the session or fees paid, at our discretion.
We reserve the right to reschedule if unforeseen circumstances arise (e.g., illness, travel, or energy considerations) and will provide suitable alternatives.
13. Intellectual Property Rights
All Content (including, without limitation, text, images, videos, graphics, frameworks, pedagogical structures, downloadable PDFs, questionnaires, course materials, session recordings, trademarks, and logos) is the sole property of Ashu Yoga or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for personal, non-commercial purposes only. You may not reproduce, modify, create derivative works from, distribute, publicly display, sell, or exploit any portion of the Content without our express written consent.
14. Limited License & Prohibited Uses
Subject to these Terms, you are granted a limited license to use the Service for personal, non-commercial purposes. You agree not to:
Republish, reproduce, distribute, or publicly display any Content unless specifically authorized.
Record (audio or video), screenshot, or reproduce any private sessions or digital products for redistribution.
Use our Content to train AI models, create derivative coaching programs, or repackage it into competing offerings.

Any violation will result in immediate termination of your access and potential legal action.
15. User Content, Testimonials & Release
If you submit feedback, testimonials, or any User Content via form, email, message, or social platform, you grant Ashu Yoga a perpetual, worldwide, royalty-free, sublicensable license to use, copy, modify, publish, translate, distribute, and display such content—unless you explicitly request confidentiality in writing. We may, at our discretion, anonymize your name or details.
If you appear in live or recorded sessions (group or private) that we later ask to use for educational or promotional purposes, we will request your permission. You may withdraw consent for future uses, but this does not affect materials already published or printed.
16. Privacy & Data Protection
We respect your privacy. We collect and process personal data in accordance with applicable data protection laws and our Privacy Policy (which is incorporated into these Terms by reference). We will never sell your personal data to third-party marketers. By using the Service, you consent to our data practices as described in the Privacy Policy. To the fullest extent permitted by law, Ashu Yoga, its owners, team members, teachers, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages—whether arising in contract, tort, negligence, strict liability, or otherwise—even if advised of the possibility of such damages. You agree to defend, indemnify, and hold harmless Ashu Yoga and its owners, employees, contractors, licensors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including but not limited to attorneys’ fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) any misrepresentation or breach of warranty by you; or (d) infringement by you or any third party using your account of any intellectual property or other right of any person or entity.
29. Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
30. Governing Law, Jurisdiction & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of courts located in Pune, Maharashtra, India.
Optional Arbitration Clause (if desired): We may, at our discretion, require that any dispute arising out of or relating to these Terms be settled by binding arbitration in Pune, under the Arbitration and Conciliation Act, 1996. Any claim must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
If any provision of this Section is found unenforceable, the remaining provisions shall be enforced to the greatest extent possible.

32. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies or guidelines posted on the Service, constitute the entire agreement between you and Ashu Yoga regarding the Service and supersede any prior agreements, communications, or understandings (oral or written) concerning the subject matter.
33. Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms at any time, for any reason.
34. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be interpreted to reflect the original intent as closely as possible.
35. Waiver
No waiver of any term herein shall be deemed a further or continuing waiver of such term or any other term, and Ashu Yoga’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
36. Survival
Sections regarding intellectual property, user content license, privacy, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution shall survive any termination or expiration of your relationship with Ashu Yoga.
37. Acceptance & Updates
By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms at any time, and such changes will be effective immediately upon posting. Your continued use after changes constitutes acceptance of the revised Terms. Please check this page periodically for updates.
38. Acceptance & Updates (expanded notice)
We may update these Terms at any time. For material changes, we will also notify active subscribers via email at least seven (7) days before the new Terms take effect. Continued use constitutes acceptance.
